Braunwyn Windham-Burke is clapping back at allegations from estranged husband Sean Burke that she doesn’t spend enough time with their kids.
“Braunwyn is in the home with the children 67 percent of the time; however, there are times where Braunwyn has left due to matters in the advice of her lawyer,” a rep for the “Real Housewives of Orange County” alum tells Pvnew exclusively.
“The custody agreement has been followed. This does not change the fact that the court has awarded Braunwyn a certain amount of alimony and child support that has not been paid since it was issued in May.”
Windham-Burke’s response comes shortly after it was revealed in court documents obtained by Pvnew that Burke is requesting a modification in child support and custody.
Together, the exes share three adult children, Bella, 23, Rowan, 21, Jacob, 18, and four minor kids, twins Caden and Curren, 10, Koa, 8, and Hazel, 5.
“Over the last few months due to Braunwyn’s personal vacations and [what’s] scheduled for November, she has only been in the home 1/3 of the time, instead of 2/3 of the time that child support was based on,” Burke, 50, states in the docs.
The businessman is asking for a decrease in half of his monthly child support payments due to a purported “substantial increased timeshare with the children” amid his ongoing divorce from Windham-Burke.
Burke splits his time between Southern California and his and Windham-Burke’s shared home in Franklin, Tenn., also occupied by her fiancée, Jennifer Spinner.
He claimed that he is with their brood “66 percent” of the time and that Windham-Burke, 45, is with them “34 percent” — the opposite of what they initially agreed upon, according to the docs.
“I have been in our primary home with all the children, without Braunwyn,” he added, “for an average of 2/3 of the time.”
As Pvnew reported in August, Windham-Burke was granted $11,000 per month from Burke in child and spousal support.
The ruling, filed July 26, showed that $6,000 will be automatically deducted from Burke’s paycheck from his employer for child support and another $5,000 will be withheld for spousal support.
Burke requested in an October filing that the monthly payment be cut in half to $3,000, which is $750 per minor child.
Windham-Burke — who came out as a lesbian in December 2020 — finally filed for divorce in October 2022 after an extended separation from Burke. They had been married for 23 years.
The former Bravolebrity, who departed “RHOC” in 2021 after two seasons, told Pvnew in March that she filed for divorce from Burke after he allegedly “emptied” their bank accounts.

“So Sean had emptied out our joint bank accounts unbeknownst to me,” she alleged further. “Literally, one day I woke up and I had no access to any of my cards or any money. And that was why I filed for divorce.”
However, in response, Burke told us that “any funds that were moved were used to pay family bills.”
Windham-Burke and Spinner got engaged in July and plan to tie the knot in October 2024.
In August, the mother of seven told Pvnew that she was on the fence about inviting Burke to the couple’s nuptials.
“It depends on the day,” she said, acknowledging the up-and-down nature of their dynamic. “I don’t know how I’m going to feel that day.”
