Kevin Costner is seeking to have his estranged wife, Christine Baumgartner, forced out of their multimillion-dollar mansion in Santa Barbara, Calif., in less than two weeks.
The “Yellowstone” star said he “respectfully requests” that the former handbag designer “vacate his separate property residence forthwith and no later than July 13, 2023,” according to new court documents filed June 30 and obtained by People on Monday.
Costner, 68, has been pushing to get Baumgartner, 49, to leave the estate for weeks, citing a premarital agreement they both signed in 2004 that stated she would leave their marital home within 30 days if a separation were ever to occur.
The movie star was also required to set her up with a separate $1.2 million property, per the binding contract.
In addition, he also reportedly offered to give his ex a $10,000 advance toward her moving costs as well as $30,000 per month for a rental house “as part of his child support obligations.”
However, even though it’s been more than two months since Baumgartner filed for divorce, she has not willingly left the lavish home.
In early June, Costner alleged that his ex was refusing to move out and trying to make him agree to “various financial demands” before doing so.
Baumgartner then argued in her response that the “Bodyguard” star had “no legal basis” to kick her out — despite their premarital agreement.
Her attorney then used the former couple’s three kids as a valid reason for why their mom deserves to stay in the same home as them, noting that the house is where the “children have lived in for their entire lives.”
Last week, Baumgartner seemed to finally be taking steps toward leaving the $145 million property, but said she would only do so under one condition: that her famous ex ensures that she has enough money to support herself and won’t be left penniless.
The former model has said in court documents previously obtained by Pvnew that she hasn’t had a paying job since her eldest child was born in 2007. She shares Cayden, 16, Hayes, 14, and Grace, 13, with Costner.
As a result, Baumgartner is seeking $248,000 a month in child support aside from an undisclosed sum of spousal support that has been previously agreed upon in the premarital agreement.
However, Costner does not agree with the amount his ex is requesting, claiming he can’t afford the amount she wants amid his changing job situation. He also accused his estranged wife of requesting that money to fund her own personal expenses.
His attorneys recently argued that Baumgartner spent more than $100,000 in cosmetic procedures, thousands of dollars in boutique shopping, ATM withdrawals, construction loans, attorneys’ fees and other costs that have “nothing” to do with her children.
Costner — who was married to the mother of this three youngest kids for 18 years — believes $51,940 a month, which is what he’s currently paying, is the “reasonable” amount.
As the exes’ battle continues to play out in court via mountains of legal paperwork, Baumgartner recently left town with two of her children for a change of scenery.
She was spotted in LAX airport in Los Angeles Thursday. It is unclear if Costner will have changed the locks once she returns.
