Olivia Wilde and Jason Sudeikis hope to have a lawsuit filed by their former nanny — who made bombshell claims about the now exes’ split — moved to a private arbitrator.

In documents obtained by Pvnew, the now exes claim Ericka Genaro’s wrongful termination lawsuit was improperly filed in California as a civil suit when it should have been filed in New York.

Sudeikis and Wilde are hoping to get the California lawsuit dismissed altogether so they can properly hash things out in a private arbitration out east.

“It is unfortunate that this private matter continues to play out in the press,” the pair said in a statement on Thursday.

“Our focus has been and will continue to be to steadfastly protect our family in the face of harassment of any kind. We are confident that the evidence brought forward will affirm our position to summarily dismiss this case and bring our family peace.”

Genaro claimed in February 2023 that the famous exes fired her after she requested to take a three-day “stress leave” due to their crumbling relationship.

The former nanny claimed that, once Wilde moved out, she suffered increased stress and anxiety due to how much more time she had to spend with their children in her absence.

(Wilde had moved out of the home to shoot “Don’t Worry Darling” in Los Angeles and Palm Springs, Calif.)

“The pressure of [Genaro] not only being the primary caretaker of the children, but also filling in Wilde’s absence for the children, became debilitating,” the documents stated.

Genaro, who worked for the pair from 2018 until 2021, is suing for punitive damages, attorney’s fees and cost of the lawsuit.

Following her filing, Wilde and Sudeikis then claimed Genaro was never actually fired. In fact, they alleged she resigned and even offered to help them out for an extra five months.

They claimed Genaro was generously paid, with the pair even doubling her salary at the end of 2020 — leading her to continue asking for more money.

It allegedly wasn’t until the exes refused to pair her salary “tax free” that the former nanny started to get upset.

They claimed Genaro threatened to “dish” to the media about her time as their nanny, which she ultimately ended up doing.

During a multi-part interview with the Daily Mail, Genaro claimed the “Don’t Worry Darling” star tricked then-boyfriend Harry Styles into thinking she and Sudeikis were over before they had actually broken up.

She also detailed the former couple’s allegedly nasty fallout, claiming Sudekis once threw himself in front of Wilde’s car to stop her from seeing Styles.

However, the former couple claims it was a breach of contract to offer up interviews and talk about their personal lives to the press.

Yet Genaro’s attorney, Ron Zambrano, responded to their latest filing, saying “it seems like a weak attempt to kick the case to a confidential arbitration in New York.”

“I am very confident the petition will be denied on procedural and substantive grounds,” Zambrano continued. “As to the underlying facts, we’ve got text messages and testimony that she was driven to quit, then was summarily fired anyway.”

“If in the unlikely event a judge or jury does not see a wrongful termination, they will most definitely see that she was not accommodated for the mental distress and anxiety that Wilde and Sudeikis were aware of, which then led to her having no choice but to resign – in other words, constructive termination.”

The former couple got engaged in 2013 and announced their split in November 2020.
