Jamie Foxx is flat-out denying claims he sexually assaulted a woman at Catch NYC & Roof in August 2015 after his accuser filed a lawsuit against him Wednesday.
“The alleged incident never happened,” a spokesperson for Foxx tells Pvnew Thursday.
“In 2020, this individual filed a nearly identical lawsuit in Brooklyn. That case was dismissed shortly thereafter.”
The rep further alleges, “The claims are no more viable today than they were then. We are confident they will be dismissed again.”
Foxx’s spokesperson concludes that the Oscar winner plans to pursue legal action against his accuser.
We’re told, “Mr. Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action.”
A woman identified only as Jane Doe claimed in a lawsuit obtained by TMZ Wednesday that the “Ray” star allegedly touched her inappropriately when she and a friend asked for a photo-op.
She claimed an “intoxicated” Foxx, whose real name is Eric Marlon Bishop, placed both hands on her waist and then moved them under her top to rub her breasts.
The unnamed woman further claimed the alleged assault became even more graphic when the “Django Unchained” star slid his hands into her pants and put his fingers on and inside her vagina and anus.
The accuser alleged that there were witnesses present, including security guards, and therefore she has also named the restaurant as a defendant in her suit.
Pvnew has reached out to a rep at Catch for comment but did not immediately hear back.
The woman claimed in the suit that she had to undergo medical treatment and suffered emotional distress as a result of the alleged “sexual assault, abuse, assault and battery.”
Even though the alleged incident took place nearly a decade ago, she was able to file her case while the New York’s Adult Survivors Act is still active.
The law allows alleged victims of sexual offenses to file civil suits even though the statute of limitations may have passed. It notably expires on Friday.
